Overview

What is Trademark Registration?

A registered trademark gives you exclusive nationwide rights to your brand name, logo, tagline or packaging — protecting you from copycats and building serious customer trust. Akshay B2B Solutions handles the full lifecycle: trademark search, class selection across the 45 NICE classes, application filing, examination response, opposition handling, hearings and 10-yearly renewal.

How we get this done

A clear, predictable sequence — no chasing, no surprises.

  1. 01

    Trademark search

We search the Trade Marks Registry to confirm your name/logo isn't already registered or pending.

  2. 02

    Class selection

We pick the right class(es) from the 45 NICE classes based on your products/services.

  3. 03

    Application filing

TM-A filed online — you can use ™ from this day. Application number issued within 24 hours.

    Examination

Registry examines the mark in 4–8 months. We reply to any objections under sections 9 / 11.

  5. 05

If accepted, the mark is published for 4 months. Anyone can oppose; we handle counter-statements if needed.

  6. 06

    Registration certificate

If unopposed, the certificate is issued and you can use ® — total timeline 12–24 months.

FAQ

Common questions

Quick answers to the things founders ask us most.

How much does trademark registration cost?

Government fee is ₹4,500 per class for individuals / startups / small enterprises (with Udyam) and ₹9,000 per class otherwise. Our professional fee is on top.

Can I start using ™ before registration is granted?

Yes — ™ can be used from the day of filing. ® can only be used after the registration certificate is issued.

How long is a trademark valid?

10 years from the date of registration. Renewable indefinitely by filing TM-R every 10 years.

Can someone copy my brand if I don't register?

Unregistered marks have only common-law protection (passing off), which is harder and costlier to enforce. Registration gives you statutory rights.

What if my application is objected to?

We file a written reply within 30 days addressing the examiner's grounds, attend hearings if needed, and push the application towards acceptance.

Should I register my logo separately from my name?

Best practice: register the wordmark and the logo separately (or as one composite mark). Wordmark gives the strongest protection on the name itself.
